FCH Trademark Policy

We here at FairChanges support and encourage ideas, services, and tools that use and supplement the FairChanges services; however, we are also serious about protecting our reputation and brand identity.

Without these FairChanges Trademarks protection policies, it could be the case that the trademarks were used, without authorization, on products or services contrary to our philosophy of sustainability, respect for the environment, disintermediation, fair trade, ecology, human rights, etc. This would seriously damage our site and our community and we don’t want to risk this. We have created these guidelines to help FairChanges members, FairChanges Teams, and others refer to us or our services without compromising the strength of our trademarks or our brand identity. In other words, these guidelines only concern the use of FairChanges’ intellectual property (for example, the use of the term “FairChanges”). For issues regarding any intellectual property which is not exclusively owned by FairChanges, Inc. please refer to FairChanges Copyright and IP Policy.

FairChanges Trademark Guidelines

The word FairChanges, FCH, its graphics, logos, designs, page headers, button icons, scripts, service names, etc. (together, the “FairChanges Marks”) are property of FairChanges.

Why must FairChanges Protect the FairChanges Marks? FairChanges must be to able assure Internet users and others that only the services offered, sponsored, or endorsed by FairChanges actually bear the FairChanges Marks. Trademark law requires that we not only protect against improper use of the FairChanges Marks, but also protect against the use of confusingly similar marks.

In order for you to help us protect the FairChanges Marks, we ask the following:


  • • Do make fair use of FairChanges’ Marks. FairChanges supports free speech and you do not need permission to make legitimate commentary about FairChanges, the company, or FairChanges’ services. So long as it does not seem as if you are pretending to be a FairChanges employee or other similar situation, you may use the word FairChanges to describe where you buy and sell all things handmade. For example you can say “I found this awesome shirt on FairChanges,” or “visit my FairChanges shop.” Also, you may have a section of your blog, for example, “Daily FairChanges picks.” You do not need to fill out a form for these types of uses. When in doubt, email legal@fairchanges.com and we’ll be happy to talk you through it.

  • • Do write FairChanges with no blanks and Do distinguish the FairChanges Marks from surrounding text by, for example, capitalizing the F and C letters of the FairChanges Marks.

  • • Do spell the FairChanges and FCH Marks properly.


  • • Do not say things about FairChanges you know are not true.

  • • Do not incorporate the FairChanges Marks or a confusingly similar mark into, for example, the name of your business, organization, non-profit organization, event, or trademark.

  • • Do not remove, alter, distort or modify the FairChanges Marks, including adding other terms to the FairChanges Marks to create new words.

  • • Do not use the FairChanges Marks or a confusingly similar mark in a way that falsely implies a relationship or affiliation with, sponsorship, or endorsement by FairChanges, Inc. or that can be reasonably interpreted to suggest information comes from, or represents the views or opinions of FairChanges, Inc. or a FairChanges employee.

  • • Do not, without prior permission, use the FairChanges Marks in a product. Please read about applying for a license to use a FairChanges Mark in connection with a product at FairChanges Trademarks – Applications.

  • • Do not use any trademarks, service marks, trade dress, designs or logos that are confusingly similar to the FairChanges Marks or the look and feel of the FairChanges website.

  • • Do not use the FairChanges Marks in any way or on any website that contains or promotes adult content, gambling, or otherwise violates applicable law or regulation.

  • • Do not use the FairChanges Marks in a manner that is in FairChanges’ sole opinion misleading, unfair, defamatory, infringing, libelous, disparaging, tarnishing, obscene or otherwise objectionable to FairChanges.

Examples of use

To help clarify these guidelines, please check out the examples below. Keep in mind these are just examples and do not include every fair and not fair use of the FairChanges Marks.

Business Cards, Promotional Items and Advertisements

  • • You may write your FairChanges URL (for example, http:// FairChanges.com/yourshop) on a business card, promotional item or advertisement in a way that doesn’t improperly suggest that you work for FairChanges, Inc.

  • • You may not make a business card, promotional item, or advertisement that uses the FairChanges Marks, stylizations, or colors so that will likely confuse the public as to your relationship with FairChanges, if any. Please do not use the FairChanges logo on your business cards.

Websites, Blogs and Social Network Profiles

  • • Always make it clear both visually and in text that your site is run by you and is not run by FairChanges.

  • • You may use the FCH Widgets and FCH Badges to link back to your FairChanges Shop.

  • • You may not use the FairChanges Marks (for example, the FairChanges logo) or a confusingly similar mark on a site that contains or promotes adult content, gambling, or otherwise violates applicable law or regulation.

Applications, Web Services, Websites, or Code using FairChanges Data Feeds or APIs

  • • Always comply with all applicable Terms and Conditions.

  • • Always make it clear both visually and in text that your site is run by you and is not run by FairChanges.


  • • You may write your FairChanges URL (for example, http:// FairChanges.com/yourshop) on your product.

  • • You may apply to get prior permission to make a product featuring a FairChanges Mark.


  • • Please name your event to clearly indicate who is hosting the event. This will help avoid missed communications while ensuring you get proper credit for your hard work. Do not name your event, for example, “FairChanges Eco World” because the people would think that FairChanges is organizing the event and would contact FairChanges instead of you. You could name the event “Barcelona Eco,” for example, and add “with products of yourname.fairchanges.com” or “with twenty sellers from FairChanges” or simply name your event “Barcelona Eco with FairChanges sellers”.

  • • If you want FairChanges to sponsor or endorse an event, please contact FairChanges in advance to request a written license and authorization.

Business Name

  • • You may not use the word “FairChanges” or a confusingly mark in the name of your business, LLC or not-for-profit organization.

  • • Without permission, please do not use the word “FairChanges” in your FairChanges Username.

FairChanges Trademarks – Applications

FairChanges members may apply to use a FairChanges Mark in connection with a product through FairChanges’ Trademark Permissions Program. So long as you comply with FairChanges Terms and Conditions, and other FairChanges policies, FairChanges often grants limited permission to use the approved FairChanges Marks. However, FairChanges will not grant permission to use the FairChanges Marks in a drop shipped item, a mass-produced product, or a product that otherwise, in FairChanges’ opinion, violates the FairChanges policies and philosophy, specially but not limited to, environmentally and human rights friendly, and without the middleman.

To apply to use the FairChanges Marks in a product, email the following information to legal@fairchanges.com:

  • • Your contact information: FairChanges Shop, full name, email address, address, phone number.

  • • Information about the FairChanges Marks you want to use: What specific FairChanges Mark do you want to use? Do you want to use the FairChanges name, the rectangle logo, another FairChanges Mark?

  • • Information about the items: What will you make? How will you make the items? How will you use the FairChanges Marks?

  • • Information about the quantity: How many of the items will you make each year? (This can be an estimate but we need a number).

  • • Information about selling the items: Where will you sell the items?

  • • Image of the product.

  • • Any other relevant information.
